General Terms and Conditions (GTC) of MEN OF MAYHEM GmbH
1. Scope and contracting party
Scope: These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop at www.men-of-mayhem.com between you as the customer and us, MEN OF MAYHEM GmbH, Neumann-Reichardt-Straße 27-33, 22041 Hamburg, Germany.
Contracting party: For orders with a delivery address within Germany, MEN OF MAYHEM GmbH is your direct contracting party. For orders with a delivery address outside Germany, we cooperate with our e-commerce partner Global-e (Global-e UK Ltd., 154 Clerkenwell Road, London EC1R 5AB, United Kingdom). In these cases, the purchase contract is concluded not with MEN OF MAYHEM GmbH but with Global-e as the seller. For international orders, MEN OF MAYHEM GmbH acts merely as the operator of the website and not as the contracting party to the purchase contract.
Global-e Terms of Sale: For orders processed via Global-e, the Terms of Sale of Global-e apply exclusively. You can view the respective current version at the following link: https://www.global-e.com/tos-de. Please note that, after a successful order and payment review, Global-e sells the products to you in its own name. MEN OF MAYHEM GmbH remains the product provider in the background, but without becoming a party to the purchase contract.
Applicability for consumers and businesses: Unless stated otherwise, these GTC apply equally to consumers and businesses. A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity that, when concluding the legal transaction, acts in the exercise of its trade, business or profession.
2. Conclusion of contract
Product presentation: The presentation of the products in the online shop does not constitute a binding offer, but rather an invitation to place an order. You can select products from our range without obligation and place them in a virtual shopping cart using the "Add to cart" button. There you can view and change your entries at any time.
Ordering process: When you complete the ordering process, by clicking the "Buy now" button (or a similarly labelled button) you submit a legally binding offer to purchase the goods in the shopping cart. Immediately after submitting your order, you will receive an automatic order confirmation from us (or, for international orders, from Global-e) by email. This order confirmation documents that your order has been received by us, but does not yet constitute acceptance of your offer.
Acceptance of contract: The purchase contract is only concluded when we accept your offer by means of an express order confirmation by email or by dispatching the goods. For orders within Germany, acceptance is carried out by MEN OF MAYHEM GmbH. For orders via Global-e, acceptance is governed by the rules in the Global-e Terms of Sale – as a rule, it takes place by dispatch confirmation from Global-e or by delivery of the goods. If we or Global-e are unable to accept your order, you will be informed of the unavailability of the goods instead of an acceptance; any consideration already received (e.g. payments) will be refunded without undue delay in this case.
Contract language and storage: The contract language is German; for international orders via Global-e, additional languages may be offered at checkout, but in the event of discrepancies, the German-language version of the GTC prevails. The contract text (your order and these GTC) is not stored by us in a form accessible to you. However, you can view and print these GTC on our website at any time. For orders via Global-e, the storage and communication provisions of Global-e in accordance with its Terms of Sale additionally apply.
Minimum age: By submitting your order, you confirm that you are at least 18 years old. Persons under 18 are not permitted to make purchases in our online shop.
3. Right of withdrawal
Consumers (see definition in section 1) are entitled to a right of withdrawal in accordance with statutory provisions. This means you can withdraw from the contract within 14 days without giving any reason. Details on the right of withdrawal – in particular the withdrawal period, exercise and the consequences of withdrawal – can be found in our cancellation policy, which we provide to you during the ordering process and make available on our website under the section Right of Withdrawal/Cancellation Policy.
Please note that the right of withdrawal does not apply to customers who are businesses within the meaning of § 14 of the German Civil Code (BGB), i.e. who act in the exercise of their trade, business or profession when concluding the contract. In such cases, there is no statutory right of withdrawal.
4. Prices and payment terms
Prices: All prices stated on the product pages are final prices and include statutory value added tax (VAT). Any shipping costs are shown separately during the ordering process. For deliveries within Germany, prices include German VAT; for international deliveries, prices may be adjusted in accordance with the taxes applicable in the destination country, which is shown in the Global-e checkout.
Currency: Billing within Germany is carried out in euros (€). For international orders via Global-e, you can pay in the local currency specified by the destination country or selected by you; the currency is shown accordingly in the Global-e checkout.
Payment methods (Germany): Payment processing for orders within Germany is handled via Shopify Payments and via supplementary payment providers. The payment methods available in each case (including common credit and debit cards such as Visa, Mastercard, American Express and Maestro, wallet payments such as Apple Pay and Google Pay, Klarna and PayPal) are shown to you during the ordering process (checkout). We reserve the right not to offer certain payment methods in individual cases.
Payment processing (international): For orders via Global-e, payment processing is governed by the terms of Global-e. In the checkout process provided by Global-e, various payment methods (e.g. credit card, PayPal, local payment methods, etc.) are available depending on the destination country. The payee in these cases is Global-e (and not MEN OF MAYHEM GmbH). This means that your payment method is billed by Global-e and you may see the charge under the name Global-e on your account/credit card statement. Global-e generally collects the invoice amount immediately upon order (unless otherwise stipulated in the Global-e Terms of Sale). MEN OF MAYHEM GmbH receives the purchase price from Global-e only after the purchase contract between you and Global-e has been concluded.
Payment due date: Unless otherwise agreed, the purchase price is due immediately. For advance payment/bank transfer within Germany, we will provide you with our bank details in the order confirmation. For credit card payments, your card is charged upon dispatch of the goods (for international orders, the charge may be made by Global-e already when the order is placed). If third parties are commissioned to process payments (e.g. PayPal or Global-e as a payment service provider), their general terms and conditions apply additionally.
5. Delivery and shipping
Delivery area: We offer deliveries to addresses in Germany as well as to further international delivery countries. You can find the available delivery countries in the shipping information on our website. Please note that for deliveries outside Germany, processing is carried out via Global-e (see section 6).
Shipping costs: For domestic deliveries (Germany), unless free of charge above a certain order value, we charge a flat shipping rate per order. The exact shipping costs and the thresholds for free delivery can be found in our information during the ordering process or on the Shipping Terms page. International shipping costs are shown accordingly in the Global-e checkout and may vary depending on the destination country. Any customs duties, import taxes or other charges for international shipping are also shown at checkout – provided they are collected in advance.
Delivery time: Delivery times depend on the availability of the goods and the place of delivery. Unless otherwise stated, the delivery time within Germany is approximately 2-5 working days after receipt of payment. For international deliveries, delivery times may vary depending on the destination country; corresponding information is provided in the Global-e checkout. Please note that customs clearance may cause delays for international shipments that are beyond our control.
Partial deliveries: We are entitled to make partial deliveries, provided this is reasonable for you. If an ordered item is unavailable or delivery is delayed, we will inform you promptly. For orders via Global-e, Global-e will inform you of any delays or split deliveries in accordance with its terms.
Transfer of risk: For consumers, the risk of accidental loss and accidental deterioration of the sold goods during shipping only passes upon handover of the goods to the consumer or a recipient designated by them. If the customer themselves acts as the carrier or independently commissions a shipping company to carry out the delivery, the risk passes upon delivery of the goods to the transport company. For businesses, the transfer of risk takes place upon handover of the goods to the transport company.
6. International shipping via Global-e
For orders with deliveries outside Germany, our partner Global-e handles the complete processing of the order, payment and delivery:
Conclusion of contract and role of Global-e: As explained in section 1, for international orders the purchase contract is concluded between you and Global-e, not with MEN OF MAYHEM GmbH. Global-e acts as the merchant and seller of the goods and purchases the ordered products from us in order to resell them to you. MEN OF MAYHEM GmbH remains the manufacturer or brand provider of the products, but is not your contracting party for the purchase contract in the case of international deliveries.
Applicable terms: For the international purchase, the General Terms and Conditions of Global-e (Terms of Sale) apply, available at https://www.global-e.com/tos-de. These terms govern, among other things, the ordering process, payment, delivery, any customs and import duties, as well as withdrawal and return rights for international orders. Please read the Global-e terms carefully; as part of the checkout process, you must agree to them before completing an order.
Customs and taxes: Global-e ensures that all applicable customs duties, import VAT or other charges for shipping to your delivery country are shown at checkout and – where possible – collected in advance. In many cases, you have the choice of paying import charges in advance (Delivered Duty Paid) or, where applicable, paying them to the relevant authorities on delivery. The corresponding options and costs are shown to you during the ordering process. MEN OF MAYHEM GmbH has no influence on the amount of such charges. If import charges are collected in advance by Global-e, the goods are already cleared through customs and taxed upon delivery to you.
Customer service for international orders: For questions, concerns or warranty cases relating to international orders, you are welcome to contact us, but we may forward your request to Global-e. You can also contact Global-e customer service directly, as stated in the Global-e Terms of Sale. As Global-e is your contracting party, for example the reversal of payments, returns and refunds in the context of international orders are carried out in cooperation with Global-e in accordance with its policies.
Through this cooperation with Global-e, we want to ensure that international customers receive a smooth purchasing process with local currency, comprehensive tax service and efficient deliveries. MEN OF MAYHEM GmbH thanks you for your understanding that, for international orders, the business relationship in the legal sense is concluded with Global-e.
7. Retention of title
Until full payment of the purchase price, the delivered goods remain the property of MEN OF MAYHEM GmbH. This applies to domestic orders; for international orders via Global-e, Global-e correspondingly retains title to the goods until full payment.
In the event of breaches of contract on your part, in particular default of payment, we are entitled to withdraw from the contract and demand the return of the goods. To businesses, we grant an extended retention of title: they may resell the goods in the ordinary course of business, but already now assign to us all claims in the amount of the invoice amount that arise for them from the resale. We hereby accept this assignment.
8. Warranty (liability for defects)
Statutory warranty rights (liability for defects) apply to our goods. This means that if the delivered items are defective (e.g. have manufacturing or material defects or do not correspond to the description), consumers are entitled, within the framework of the statutory provisions, to subsequent performance (rectification of defects or replacement delivery) and – where the statutory requirements are met – to the further rights of reduction of the purchase price or withdrawal from the contract, as well as to damages.
Businesses must report obvious defects in writing within a period of 7 days from receipt of the goods, otherwise the assertion of the warranty claim is excluded. Timely dispatch of the notice of defect is sufficient to meet the deadline. Hidden defects must be reported immediately after discovery.
Otherwise, the statutory provisions apply. We only provide an additional guarantee if this was expressly stated for the respective item. Any manufacturer's guarantees remain unaffected and exist exclusively in accordance with their terms. For international orders, warranty claims may, in accordance with the Global-e terms, be asserted either through us in cooperation with Global-e or directly against Global-e, as Global-e is your contracting party.
9. Liability
Unlimited liability: We are liable without limitation for intent and gross negligence. Furthermore, we are liable without limitation for damage arising from injury to life, body or health based on an intentional or negligent breach of duty by us. We are likewise liable without limitation under the provisions of the German Product Liability Act, as well as within the scope of any guarantees assumed.
Liability for slight negligence: In the case of a slightly negligent breach of essential contractual obligations (so-called cardinal obligations), we are liable – except in the cases mentioned above – only in the amount of the foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely.
Exclusion of liability: Otherwise, liability for slightly negligent breaches of duty is excluded. This applies in particular to consequential damage, lost profit or other financial losses that did not arise on the object of delivery itself.
Contributory negligence and unforeseeable circumstances: Liability for delays or non-performance due to force majeure or other unforeseeable circumstances beyond our control (e.g. natural disasters, pandemics, official interventions, strikes, supplier failures, etc.) is excluded. In such cases, any performance periods are extended appropriately.
Liability of vicarious agents: Insofar as our liability is excluded or limited, this also applies to the personal liability of our legal representatives, employees and vicarious agents.
Liability for international orders: For contracts concluded via Global-e, the liability provisions of Global-e in accordance with its Terms of Sale apply with priority. In such cases, MEN OF MAYHEM GmbH is generally not directly liable to the customer, as the contractual performance obligation lies with Global-e. However, we endeavour to provide mediating support in the event of problems, insofar as this is possible.
10. Dispute resolution
Customer service: Your satisfaction is important to us. You can contact our customer service at any time with questions or complaints – by email at service@men-of-mayhem.com or by phone at the number stated in the legal notice. We endeavour to resolve your concerns promptly.
Alternative dispute resolution: The European Commission provides a platform for online dispute resolution (ODR), which you can reach at the following link: https://ec.europa.eu/consumers/odr/. Our email address is: service@men-of-mayhem.com. We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
Internal complaint processes: We take any complaints seriously and will seek an amicable solution together with you. If no agreement can be reached, you are of course free to take legal action or – where applicable – to call upon a recognised arbitration board.
11. Applicable law and place of jurisdiction
Choice of law: For contracts between MEN OF MAYHEM GmbH and the customer, the law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). However, for consumers with their habitual residence in a member state of the European Union, mandatory consumer protection provisions of that state of residence may also apply, provided they are more favourable to the consumer (favourability principle).
Place of jurisdiction for domestic orders: If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office (Hamburg, Germany). The same applies if you have no general place of jurisdiction in Germany or if your domicile or habitual residence is unknown at the time the action is filed. The right to also bring an action at a statutory place of jurisdiction remains unaffected.
Place of jurisdiction for international orders: For orders via Global-e, the place of jurisdiction and applicable law are governed by the contractual agreements in the Global-e Terms of Sale. Please refer to the Global-e terms for information on this. As a rule, either the law of the country in which you are domiciled or the law of the country in which Global-e is based is determined to apply. Unless otherwise stipulated in these Global-e terms, German law also applies to any non-contractual claims in connection with international orders, but only to the extent that it is compatible with the mandatory consumer protection laws of the country of your habitual residence.
12. Final provisions
Contract text and amendments: We reserve the right to amend these GTC with effect for the future, provided there is a legitimate reason to do so (e.g. adaptation to changes in the law, expansion of the range, changes to the payment or shipping terms). The respective current version of the GTC is published on our website. Contracts already concluded are subject to the GTC valid at the time of the order, unless an amendment is ordered by law or by an authority.
Severability clause: Should individual provisions of these GTC be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected. In place of the invalid or unenforceable provision, the relevant statutory provisions apply. The same applies in the event of a contractual gap.
Contract information: The contract language is German. Customers have the option at any time to retrieve these GTC on the website and save them in reproducible form. The technical steps and correction options available for concluding the contract in the ordering process, as well as further information on the conclusion of the contract, result from the above provisions and the notices in the ordering process.
